Terms of service

Agreement

These terms govern access to Pitcher's Digest and Hitter's Digest, an online baseball reporting service provided by Parden LLC. By creating an account, purchasing a subscription, or using the service, you agree to these terms and the linked policies.

The service

The service imports authorized baseball data and produces postgame, scouting, pitch-profile, spray-chart, and related reports. Reports are analytical tools and do not guarantee player performance, health, recruiting, roster, or competitive outcomes.

Accounts and authority

You must provide accurate account information and protect your credentials. You represent that you are an adult with authority to act for yourself or your organization and that you have all rights and permissions required to submit, access, and process the TrackMan, game, player, and organization data used with the service.

Subscriptions and payment

Subscriptions are offered at $420 USD per month or $4,050 USD per year, plus any applicable taxes. Stripe processes payments through hosted Checkout. Subscriptions renew automatically on the applicable schedule until canceled. Current renewal information is available in Stripe's Customer Portal.

Parden LLC may change future pricing or plan features with reasonable advance notice. A change applies no earlier than a later renewal unless you expressly agree otherwise.

Cancellation, delivery, and refunds

You may cancel through the Stripe Customer Portal or customer support. Cancellation ordinarily takes effect at the end of the paid billing period. Digital delivery and refund conditions are explained in the delivery, cancellation, and refund policy, which is incorporated into these terms.

Acceptable use

You may not use the service unlawfully; access data without authorization; upload malicious code; interfere with security or availability; attempt to discover another customer's data; share access in a way that defeats account controls; resell the service without written permission; or reverse engineer the service except where applicable law expressly permits it.

Customer data and service ownership

You and your licensors retain ownership of data you submit. You grant Parden LLC the limited rights needed to host, copy, process, secure, and produce reports from that data for the service. Parden LLC retains ownership of the application, report designs, software, branding, documentation, and other service materials, excluding customer data and third-party materials.

Availability and changes

We work to provide a reliable service but do not promise uninterrupted or error-free availability. Maintenance, source-data issues, third-party outages, network failures, or security needs may temporarily affect access. Features may evolve, provided changes do not remove paid access without an appropriate remedy.

Disclaimer and limitation

To the extent permitted by law, the service is provided “as is” and “as available.” Parden LLC disclaims implied warranties that can legally be disclaimed. To the extent permitted by law, Parden LLC is not liable for indirect, incidental, special, consequential, or punitive damages, lost profits, lost opportunities, or decisions made from report results. Nothing in these terms limits liability that cannot legally be limited.

Suspension and termination

We may suspend or terminate access for nonpayment, unlawful use, security threats, material breach, or conduct that risks harm to the service or others. When practical, we will provide notice and an opportunity to cure. Provisions that by nature should survive termination remain effective.

Changes to these terms

We may update these terms as the service or applicable requirements change. The effective date above identifies the current version. Material changes may be communicated through the service or by email. Continued use after an effective update constitutes acceptance where permitted by law.
